Nevada signed legislation to restrict PFAS and OFRs in some products

Nevada governor of the United States has signed the AB97 act prohibiting the use of perfluoroalkyl and fluoroalkyl substances PFAS in class B fire foam, limiting the use of halogen flame retardants in children's products, upholstered furniture, certain textile products and mattresses. The main points of the bill are as follows:


PFAS and OFRs


Perfluoroalkyl and polyfluoroalkyl substances (PFAS)


It is prohibited to discharge, use or release B fire fighting foam intentionally added to PFAS for testing or fire training purposes.


The ban takes effect on January 1, 2022.


Organic halide


It is prohibited to manufacture, sell, provide for sale, distribute or use children's products, residential upholstered furniture, residential textiles, commercial textiles or mattresses containing more than 1000ppm organic halogen flame retardants.


The ban takes effect on July 1, 2022.


Exemption:


1.Any of the following halogen flame retardants:

a. It's a polymeric substance;

b. Safety has been established under 15 U.S.C. 2604 or 2605.

2.Previously owned products contain halogen flame retardants.

3.Electronic components of children's products, mattresses, upholstered residential furniture or residential textiles, or related enclosures of electronic components.

4.Children's products, mattresses, cushions, residential furniture or residential textiles with federal or national flammability standards.

5.A thread or fiber that stitches mattress parts together.

6.Adult mattress parts except foam.


Note:


"Children's products" means products designed or intended for use by manufacturers primarily for children under 12 years of age. However, children's products do not include toys, outdoor sports equipment, tents, sleeping bags or other devices and electronic products that comply with the latest version of ASTM F963 (please read the details of the bill).
