On July 16, 2021, the U.S. Federal Trade Commission (FTC) issued a final regulation on "made in the U.S." and other non-conforming U.S. origin claims on product labels. This final regulation will come into effect on August 13, 2021.
This regulation covers the labeling of products that do not comply with Musa claims. It codifies the committee's previous Musa decisions and decrees, and prohibits salespeople from printing unqualified Musa claims on labels unless:
The final assembly or processing of the product is carried out in the United States,
The main processing of all products is carried out in the United States, and
All or almost all components or parts of the product are manufactured and purchased in the United States.
The regulation also includes labels that appear in mail order catalogs or mail order advertisements that are not qualified for mus claims. In order to avoid confusion or conflict with other country of origin labeling laws and regulations, it does not replace, change or affect any other federal or state laws or regulations related to country of origin labeling, unless the country of origin laws, regulations, decrees or interpretations are inconsistent with this regulation.
