Brazil announced the quality regulation of new toys - INMETRO Decree No. 302 / 2021

The Brazilian National Institute of metrology, quality and Technology (Inmetro) published INMETRO Decree No. 302 / 2021 - "quality and technical regulations and conformity assessment requirements for toys". The decree entered into force on August 2, 2021. The following are the key elements of the act:

1. The act repeals the following acts on the following dates:

● INMETRO Decree No. 8 / 1997: repeal immediately

● INMETRO Decree No. 108 / 2005: repealed on July 1, 2025

● INMETRO Decree No. 369 / 2007: repealed on July 1, 2025

● INMETRO Decree No. 321 / 2009: repealed on July 1, 2025

● INMETRO Decree No. 152 / 2010: repealed on July 1, 2025

● INMETRO Decree No. 377 / 2010: repealed on July 1, 2025

● INMETRO Decree No. 117 / 2011: repealed on July 1, 2025

● INMETRO Decree No. 563 / 2016: repealed on January 1, 2022

● INMETRO Decree No. 217 / 2020: repeal immediately

The relevant Inmetro decrees (INMETRO Decree No. 133 / 2003, INMETRO Decree No. 49 / 2008, INMETRO Decree No. 459 / 2014 and INMETRO Decree No. 99 / 2016) will be restored to effect from the date of promulgation of this decree, and will continue until July 1, 2025, when these decrees will also be repealed.

2. The decree also contains the following important provisions.

● Unified regulations on toys have been formulated, including quality and technical regulations (Annex I), conformity assessment requirements (Annex II) and conformity identification seal specifications (Annex III). Suppliers can choose certification mode 1b, mode 2 or mode 5 for conformity assessment;

● Certified toys are required to be registered with Inmetro;

● Provide that toys falling within the scope of the act shall be subject to market supervision by Inmetro and other public law enforcement agencies;

● If required by Inmetro, the supplier shall provide the required information within 15 days;

● Provide a list of products considered to be within the scope of toys (Annex IV) and a list of products not toys (Annex V).
