Ukraine Publishes Draft Resolution on Toy Safety to Further Align with the EU

Ukraine has issued a draft resolution on toy safety. If approved, the new law will enter into force six months after its publication in the Official Journal.

In 2018, Ukraine published Resolution of the Cabinet of Ministers No. 151 of February 28 to approve  the nation’s Technical Regulations on the Safety of Toys (Technical Regulation), a piece of legislation where the safety requirements are essentially similar to those in Directive 2009/48/EC in the EU (Toy Safety Directive, TSD, consolidated version to May 2021). Since its publication, the Technical Regulation has implemented provisions from the TSD – strengthened migration limits for aluminum and chromium (VI), as well as restricting formaldehyde in certain toys (SafeGuardS 50/21).

On December 21, 2021, the World Trade Organization (WTO) circulated a notification from Ukraine’s Ministry of Economy announcing a draft Resolution to revise the Technical Regulation. This proposal, attached to WTO document number 21-9557, would further align the nation’s toy safety with those in the TSD.  The draft Resolution contains important changes to Annex 2 of the Technical Regulation. It:

· Adopts the allergenic fragrances from Directives (EU) 2020/2088 and (EU) 2020/2089 (SafeGuardS 188/20)

· Restricts aniline in toys that are intended for children under 36 months, or in other toys intended to be placed in the mouth


There are several proposed effective dates:

· June 2022 for date of adoption

· December 2022 for date of entry into force (six months after publication)

· December 5, 2022 for the restriction of aniline (Table 1 above)
